Registration Requirements

Thank you for your interest in the Noridian Medicare Portal, Noridian Healthcare Solutions' application allowing access for authorized Medicare suppliers and providers; hereafter referred to as providers, to Medicare eligibility and claim information.

The process and expectations for the Noridian Medicare Portal registration are defined in the steps below.

  1. Agreements - Registration begins with a presentation of a series of agreements to read and accept. When prompted, read and accept all conditions of the policies/agreements. Agreements are listed below for reference.

Privacy Statement

Noridian Healthcare Solutions (Noridian) contracts with the Centers for Medicare & Medicaid Services (CMS) and is a CMS contractor under the authority granted in Sections 1842, 1862 (b) and 1874 of Title XVIII of the Social Security Act (the Act) (42 United States Code (U.S.C.) §§1395u, 1395y (b), and 1395kk).

As a CMS contractor, Noridian maintains the four (4) websites identified below, three of which are public and one that is non-public.  Noridian is providing this notice to you concerning (i) how Noridian might use or disclose personally identifiable information (PII) that you might provide while visiting our public websites at www.noridianmedicare.com or http://www.edissweb.com and (ii) how we might use or disclose PII or protected health information (PHI) that a health care provider might provide when using the non-public provider portal at https://www.noridianmedicareportal.com/.

PII means any information that alone, or in combination with other data elements, could be used to identify you, such as a name, address, telephone number, social security number, or other personal identifier unique to you (e.g., Medicare provider/supplier number).  In general, PHI means individually identifiable health information that is created by a health care provider or other covered entity that relates to the health or condition of an individual.

Protecting your privacy is very important to us. We understand that visitors to our public websites and providers who visit our non-public provider website need to be in control of their personal information, which is why we actively protect the privacy of everyone who uses our various websites. We are telling you about the Noridian public and non-public website privacy policy so you know what information we collect, why we collect it, and what we do with it. This policy covers the following public and non-public websites:

Information Provided By Visitors On Public Websites

Noridian’s public websites do not collect any PII about you during your visit unless you choose to provide it to us.

We do, however, collect information from visitors who read, browse, and/or download information from our websites. We do this so we can understand how the public uses the website and how to make it more helpful. None of Noridian’s websites – public or non-public – collect information for commercial marketing or any purpose unrelated to our mission and goals.

How We Use, Disclose And Collect PII That Visitors’ Choose To Provide

You do not have to give us PII to visit Noridian’s public websites. If you choose to provide us with PII, we will maintain the information you provide only as long as needed to respond to your question, grant access or to fulfill the stated purpose of the communication.  Groups of records that contain PII about an individual and are designed to be retrieved by the individual's name or other personal identifier linked to the individual will be safeguarded in accordance with the Privacy Act of 1974, Health Insurance Portability and Accountability Act of 1996 (HIPAA), CMS’ Information Security Acceptable Risks Safeguards (ARS) and other CMS contract requirements.

PII collected via any Noridian website is kept on secure servers and is accessed only by staff members with a business need to use it. This information is disposed of in accordance with the Noridian Records Retention program when no longer needed. On occasion, PII collected is requested by, and shared with the CMS for use in contract activities. In accordance with CMS regulations, collected information is not disposed of; instead, it is kept on an indefinite basis. If Noridian transmits your protected data to CMS or any CMS-contracted entities, Noridian will ensure the data is encrypted according to CMS standards.

How We Use, Disclose and Collect PII and PHI That Health Care Providers’ Enter Into Our Non-Public Provider Portal

Noridian as a CMS contractor will collect PII from health care providers using the non-public provider portal if they specifically and knowingly choose to provide it to us. We will use the PII only in connection with our services as a CMS contractor, or for such purposes that we describe to you at the point of collection. For example, health care providers might submit PII in connection with their enrolling to use Noridian’s secure provider portal. In such a case, Noridian will actively guard any PII they provide and will not disclose, give, sell or transfer any such personal information to third parties. If we share demographic information with third parties, we will give them aggregate information only. By supplying Noridian with PII, the health care provider users have consented to allowing Noridian to use that PII in any way in accordance with CMS/HIPAA standards.

Noridian also collects PII to track those users registering for portal access. For health care providers to become users, they are required to enter in personal information (that is, name, Work phone, email address, the provider/supplier’s Tax Identification Number (TIN) or Social Security Number (SSN), organization name, trading partner ID, NPI, and PTAN). This information is used to permit them continued access to the provider portal.

Noridian also collects PII to track those users registering for educational events. Users are required to enter in personal information (that is, name, email address, company name, and so on) when registering for most education such as webinars and in-person seminars. This information is then used for continued communication with the user regarding their event registration and participation.

Users also have the option when registering on our List Serve Email newsletter to receive Medicare news and information. In order to complete this request, they need only supply their email address and name.

Noridian also uses an online survey to collect opinions and feedback. This online survey will appear at random to users. Survey respondents have the option of not including any PII in their comments. However, if the user has a question, there is an option to leave their email address. Noridian analyzes and uses this information to improve our website's operation and content

In addition to PII, health care providers might submit PHI in connection with the functionality provided through Noridian’s secure non-public provider portal.  We use and disclose such PHI only in connection with our role as a CMS contractor and then only as permitted or required under the HIPAA Privacy Rules and under our contract with CMS.  Please see the Notice of Privacy Practices applicable to CMS contractors that is published by CMS on its website for a full description of all uses and disclosures of such PHI under the HIPAA Privacy Rule.

How We Might Use or Disclose Information Collected From Third-Party Websites

Noridian uses third-party websites to collect various types of information. Some of these third-party companies (and information about their privacy policies) is listed below. Any of your activity on these third-party websites is governed by the security and privacy policies of those websites. If you choose to use any of these third-party websites, you should review their privacy policies before such use and ensure that you understand how your information may be used and disclosed.

General Information Applicable to All Noridian Websites

Web Server Usage

We may record information about how users access our websites. This information may include your IP address (or the DNS name associated with it) and what Web software you are using (browser and version). Information provided will be used only for statistical purposes to help improve this site. This information cannot be used to identify a specific individual.

While we make every attempt to protect the personal information that you share with us, it is important to realize that electronic mail is not secure against interception. If your communication is very sensitive, we recommend sending it by postal mail instead. Noridian will not use email as a form of communication if it involves sensitive information. Only telephone, fax or postal services will be used for communicating sensitive information.

Cookies

A cookie is a small piece of information that is sent to your browser when you access a website. There are two kinds of cookies, a session cookie and a persistent cookie. A session cookie is text that is stored temporarily in your computer's memory but never written to a drive. It is destroyed as soon as you close your browser. A persistent cookie is saved to a file on your hard drive. Noridian primarily uses only session cookies. A persistent cookie that expires on its own in 30 days may be used in conjunction with a website satisfaction survey, however no personal information is collected. You may be able to decline using cookies, but you may be asked to complete the website satisfaction survey each time you access it.

How to Opt Out or Disable Cookies

If you do not wish to have temporary or persistent cookies placed on your computer, you may disable them using your Web browser. If you decide to "opt out" of cookies, you will still have access to all information and resources the Noridian website provides.

Terms and Conditions for Use

Read the following terms and conditions carefully before continuing. The user must accept these terms and conditions to obtain access to the Noridian Medicare Portal. If the user does not agree to these terms and conditions, the user will not be able to use the Noridian Medicare Portal. It is suggested that the user check these terms periodically for changes. The terms can be accessed from the link located at the bottom of the Noridian Medicare Portal main menu. If the Noridian Medicare Portal is accessed after changes to these terms and conditions are posted, the user will be deemed to have accepted any changes.

User Access

Users shall have access to such applications, as Noridian Healthcare Solutions, LLC (Noridian) makes available through the Noridian Medicare Portal. Noridian reserves the right to determine the applications and level of access granted to each user.

Noridian may, without advance notice or liability, add, discontinue, or revise any aspect of the Noridian Medicare Portal, including without limitation such aspects as scope of service, availability of service, time of service availability, or the hardware and/or software required for users to access and use the Noridian Medicare Portal applications. Noridian will make reasonable efforts to provide users with advance notice of such events when practicable.

User Equipment and Remote Connect Charges

Users shall be responsible for obtaining and maintaining, at the users’ own expense, all computer hardware, software, communication equipment and access lines necessary to access and utilize the Noridian Medicare Portal.

User Names and Passwords

Role based security is enforced to ensure information is accessible on a minimum necessary/need to know basis. A user’s access is restricted to assigned Medicare provider identification numbers.

The user is responsible for maintaining the confidentiality of their user name (account ID) and password and is responsible for all activities resulting from the use of their user name and password, including unauthorized use. The user is required to immediately notify Noridian Medicare Portal Support when discontinuing use of the Noridian Medicare Portal, or in the event the user name and password are compromised or abused.

Conduct of User

The user agrees to use the Noridian Medicare Portal only for lawful purposes. The user will not post or transmit on or through the Noridian Medicare Portal any libelous, obscene, or otherwise unlawful information of any kind, and the user will not engage in any conduct involving the Noridian Medicare Portal that would constitute a criminal offense or give rise to civil liability under any local, state, federal or other law or regulation, including, but not limited to, the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and any subsequent amendments. The user will not upload, post, reproduce or distribute to or through the Noridian Medicare Portal any material protected by copyright, privacy or other proprietary right without first obtaining the written permission of the owner thereof. The user acknowledges that the Noridian Medicare Portal contains copyrighted and other proprietary and confidential information and material, and the user will respect all such proprietary rights and take such precautions as may be reasonably necessary to protect private, confidential and other proprietary information and material from unauthorized use or disclosure.

The user is responsible for compliance with all applicable policies and procedures published by payors or government agencies.

Conduct of the Administrator

As the Administrator, it is your responsibility to ensure all end users that you are responsible for, are accountable for their access.  This entails ensuring the user is not sharing id’s which is a security violation, using the data inappropriately within the Noridian Medicare Portal and notifying you when their access is no longer needed so the account can be removed.  You are also responsible to monitor the users and their access on a regular basis.  You are also responsible to approve/reject the end users requests for access in a timely manner.  You are overall accountable for all activities logged by the users you oversee.  As an Administrator, it is critical that all information you see in the Noridian Medicare Portal is kept confidential as it relates to the end users and their functionality.  Non-compliance with the above is considered to be unacceptable behavior, which is cause for Noridian to revoke all security access to the Noridian Medicare Portal.

Availability of Benefits

The data presented is not a guarantee of benefits. Benefits are only available for medically appropriate and necessary treatment that is covered according to the terms of the benefit plan and subject to the patient’s eligibility on the date of service. Benefits will be denied if the member is not eligible on the date of service.

Accuracy and Validity of Information and Opinions

Noridian will make reasonable efforts to ensure that information it contributes to the Noridian Medicare Portal is timely and accurate. However, Noridian does not warrant and assumes no responsibility whatsoever for the timeliness, accuracy, reliability, completeness or usefulness of any statement, opinion, advice, service or other information contributed by any third party.

Monitoring of the Noridian Medicare Portal

Noridian may, in its discretion and without notice, monitor the Noridian Medicare Portal and the user's use thereof to determine and ensure compliance and to protect itself and other users of the Noridian Medicare Portal from fraudulent, unlawful or abusive use, or for any other reason deemed necessary by Noridian. Noridian may also intercept and disclose any content, record, use or other information to the extent reasonably necessary to protect the rights of Noridian, for mechanical or service quality control as permitted by law, or to comply with any law, regulation, or governmental request. Noridian may also, in its discretion, review, edit, refuse to post or remove any material or information submitted or transmitted to the Noridian Medicare Portal.

On-line Updates

Noridian may, when feasible, update the Noridian Medicare Portal either with or without notice to the user. Such updates will occur automatically on-line upon the user's signing into the Noridian Medicare Portal or may occur pursuant to prompts, which appear on the user's web screen during use of the Noridian Medicare Portal. The user has no right to continued use of the prior versions after an update has been made. The user hereby consents to the process of the on-line updates, waiving any and all claims for damages, loss of data, or loss of access related thereto.

Noridian Medicare Portal System Maintenance

Planned availability for eligibility will be 24 hours/day and 7 days/week. All other options of the Noridian Medicare Portal will be available during normal claims processing system hours. The system will be brought down for occasional maintenance. To the extent possible, this maintenance will be scheduled on the weekends and off-hours when it will be least likely to cause an interruption in production. Notification of this downtime will be communicated to the user through the broadcast news messaging board on the Noridian Medicare Portal main menu.

Copyright Protection

The Noridian Medicare Portal and the content provided therein, are protected by copyright. All rights in the pages, site content, graphics, and arrangement are owned by Noridian. The user is prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works of or using any of the content from the Noridian Medicare Portal for commercial or public purposes. The user is hereby granted a revocable, limited license to use the Noridian Medicare Portal to review Medicare information and for no other reason whatsoever. Except as expressly granted herein, no license is granted to the user, and any and all other rights are reserved by and for Noridian.

Applicability of State and Federal Laws

All products and services provided through the Noridian Medicare Portal are subject to all applicable state and federal laws. This includes, but is not limited to, all laws related to insurance, employee benefits, equal employment opportunity, and the Americans with Disabilities Act.

Users’ Privacy

While Noridian is committed to protecting the privacy of its members and others, it is possible that any transmission of data on or through the Internet may be intercepted, monitored, or downloaded by an unauthorized third party. To the extent allowed by state and federal law, Noridian expressly disclaims any liability for any data transmitted by the user, intentionally or otherwise, over the Internet. THE USER ASSUMES ALL RISK FOR THE SENDING OF ANY INFORMATION, BY ANY MEANS, INTENTIONAL OR OTHERWISE, VIA THE INTERNET.

DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE NORIDIAN MEDICARE PORTAL AND INFORMATION AVAILABLE THROUGH THE NORIDIAN MEDICARE PORTAL ARE FURNISHED BY NORIDIAN AND ACCEPTED BY THE USER "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY WHATSOEVER. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, ARE SPECIFICALLY EXCLUDED AND DISCLAIMED. NORIDIAN DOES NOT WARRANT THAT THE NORIDIAN MEDICARE PORTAL, OR INFORMATION OBTAINED THROUGH THE NORIDIAN MEDICARE PORTAL SERVICES, WILL MEET THE USER'S REQUIREMENTS, THAT THE OPERATION OF THE NORIDIAN MEDICARE PORTAL WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT ALL FAILURES OF THE NORIDIAN MEDICARE PORTAL TO SUBSTANTIALLY CONFORM TO OR PERFORM SUBSTANTIALLY IN ACCORDANCE WITH NORIDIAN SPECIFICATIONS WILL BE CORRECTED. EXCEPT AS EXPRESSLY PROVIDED ABOVE AND IN SUCH WARRANTIES, IF ANY, AS MAY BE PROVIDED BY THIRD PARTY VENDORS OF EQUIPMENT OR SOFTWARE UTILIZED IN CONNECTION WITH NORIDIAN MEDICARE PORTAL, THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE NORIDIAN MEDICARE PORTAL, AND INFORMATION OBTAINED THROUGH THE NORIDIAN MEDICARE PORTAL IS WITH THE USER.

Term and Termination

Either party may, at its election and in its sole discretion, terminate access to the Noridian Medicare Portal. Noridian Medicare Portal Support may, at any time, terminate the user's access to any or all of the Noridian Medicare Portal applications without advance notice if the user has prolonged inactivity or commits any violation.

Entire Agreement

These terms and conditions set forth the entire agreement and understanding between Noridian and the user regarding the subject matter hereof and supersede any prior representations, advertisements, statements, proposals, negotiations, discussions, understandings, or agreements regarding the same subject matter. If the user has entered into an Electronic Trading Partner Agreement with Noridian, the terms of the Electronic Trading Partner Agreement remain in effect and are not superceded by this agreement.

LIMITATION OF NORIDIAN LIABILITY

IN NO EVENT WILL NORIDIAN BE LIABLE TO THE USER OR ANY OTHER PERSON FOR ANY LOST PROFITS, LOST SAVINGS, LOST DATA, OR OTHER SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY INFORMATION, PRODUCT OR SERVICE FURNISHED OR TO BE FURNISHED BY NORIDIAN UNDER THIS AGREEMENT OR THE USE THEREOF, EVEN IF NORIDIAN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE, AND THE AGGREGATE LIABILITY OF NORIDIAN UPON ANY CLAIMS HOWSOEVER ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY INFORMATION, PRODUCTS OR SERVICES FURNISHED OR TO BE FURNISHED BY NORIDIAN UNDER THIS AGREEMENT WILL IN ANY EVENT BE ABSOLUTELY LIMITED TO THE AMOUNT PAID TO NORIDIAN BY THE USER UNDER THIS AGREEMENT; PROVIDED, HOWEVER, THAT NOTHING IN THIS AGREEMENT SHALL OPERATE TO RELIEVE NORIDIAN FROM LIABILITY FOR ITS OWN WILLFUL OR WANTON RECKLESSNESS OR INTENTIONAL TORTS.
